How to sell a house in San Jose, in seven steps

Seven steps, in this order.

  1. Price against the last 90 days of comps on your street , not against active listings. Active listings tell you what did not sell.
  2. Prepare the exterior before the interior. Eight of the ten highest returning prep projects are exterior replacements. See the full breakdown in which home improvements actually add value .
  3. Stage and photograph professionally. In a market where the median home is pending in 15 days, the first weekend is the entire negotiation.
  4. Go live Thursday. That puts the listing in front of the weekend buyer pool at full strength.
  5. Hold the first weekend open , then review offers the following Tuesday or Wednesday.
  6. Negotiate terms, not just price. Contingency periods, close date, and rent back are often worth more than the last $10,000.
  7. Close in 21 to 30 days on a standard financed offer, faster on cash.

How much does it cost to sell a house in San Jose?

Two costs are fixed by law and everything else is negotiable.

Documentary transfer tax. Santa Clara County charges $0.55 per $500 of value. San Jose, Palo Alto, and Mountain View are higher at $1.65 per $500 of value, per the Santa Clara County Clerk Recorder. On a home selling at the current San Jose median of $1,469,200, that is about $4,849. In Santa Clara County the seller customarily pays it, though like everything in a contract it can be negotiated.

Measure E, the San Jose real property transfer tax. This applies only to transfers above $2.3 million, a threshold that rose from $2 million on July 1, 2025. The tiers are 0.75 percent from $2,300,000.01 to $5 million, 1 percent from $5,000,000.01 to $10 million, and 1.5 percent above $10 million. Most San Jose sellers never touch it. If your home is above $2.3 million, it is the single largest line on your closing statement after commission.

Every other line on the closing statement is negotiable, variable, or both.

That includes escrow and title fees, the natural hazard disclosure report, county and city inspection or compliance items, any negotiated repair credits, prorated property taxes, and HOA transfer documents if you are in an association. Your agent should hand you a written net sheet before you list, not after you accept an offer.

What commission will I pay to sell a house in San Jose in 2026?

Commissions are fully negotiable and are not set by law. That has always been true and it is now stated explicitly in every agreement.

What changed structurally: as of August 17, 2024, offers of compensation to buyer brokers can no longer be published on the MLS. Sellers may still offer compensation off the MLS, and may still offer buyer concessions such as closing cost credits through the MLS. Agents who use an MLS must also have a written agreement with a buyer before touring a home, and that agreement has to state the compensation as a specific number or rate, cap it, and carry a conspicuous statement that broker fees are fully negotiable. All of that comes from the National Association of REALTORS practice changes.

What it means for you as a seller: buyer agent compensation is now an explicit, separate negotiation rather than something assumed on the listing. Ask any agent you interview to put their fee, what it covers, and how they handle buyer side compensation in writing before you sign anything.

How long does it take to sell a house in San Jose?

Timeline of the San Jose home selling process from preparation through closing, showing about 15 days on market
The San Jose selling timeline. Market data from Redfin, three months ending June 2026.

Plan on 45 to 60 days from first conversation to keys, with the market doing the fast part.

Preparation is the variable. Paint, landscaping, minor repairs, staging, and photography typically run two to four weeks depending on how much the property needs and how fast your trades can schedule. Once live, the median San Jose home goes pending in 15 days, and Zillow put the median at about 19 days to pending as of July 31, 2026. Escrow then runs 21 to 30 days on a financed offer and can close in as little as 10 days on cash.

Sellers who compress the preparation window usually pay for it in the pricing. Homes that come out correct sell at 102.7 percent of list on average in San Jose. Homes that come out unprepared get one reduction, then another, then close below where they started.

Do I pay capital gains tax when I sell my house in San Jose?

Most sellers do not. Under IRS rules, you can exclude up to $250,000 of gain if you file single and up to $500,000 if you file married jointly, provided you owned the home at least 24 months out of the last five years and lived in it as your residence at least 24 months of the last five years. The two tests can be met in different periods, and you generally cannot claim the exclusion if you already excluded gain from another home sale in the prior two years.

In San Jose, where long tenure and large appreciation are common, gains above the exclusion are real and worth planning for. That is a conversation for your CPA. Rami is a licensed REALTOR, not a tax advisor or an attorney, and nothing here is tax or legal advice.

Should I sell now or wait until spring?

The data favors sellers who are ready over sellers who are waiting for a better window.

Inventory across Santa Clara County sat at roughly 2,700 active listings in July 2026 per Realtor.com data, and 58.8 percent of San Jose homes still closed above asking. That is a market with real buyers and limited competition for a prepared listing. Spring brings more buyers, and it also brings every other seller who had the same idea. A prepared home in a thinner fall market often outperforms an average home in a crowded spring one.
